This type of mediation can be voluntary where the divorcing parties have decided to come to mediation to try and separate amicably without going to court.

It can also be court ordered where the parties are already in court and the judge has ordered that they compulsorily mediate and try to reach a settlement before returning back to court.

In either event, the Mediator’s goal is try and get the parties to reach an agreement on some or all of the outstanding issues between the parties so as to minimize or eliminate further litigation.
